BEFORE THE WORK STARTS

WALLS, WATER
AND THE RULES AROUND THEM.

A few Georgia and Cobb County rules shape this work before anything is built.

Retaining wall permits

In unincorporated Cobb County, retaining walls 30 inches and taller need a permit and a design stamped by a Georgia-registered engineer. Cities inside Cobb set their own rules.

Stream buffers

Georgia keeps a 25-foot undisturbed buffer along most streams and 50 feet along designated trout waters, measured from where vegetation is wrested by normal stream flow.

Detention pond upkeep

Stormwater ponds are usually the property owner's responsibility. In Marietta, for example, the recorded maintenance agreement requires the owner to keep the pond working and inspect it every year.

LAND MANAGEMENT QUESTIONS WE GET

Start with the property and what you want to do. We'll help you work through the details.

ASK ABOUT YOUR PROJECT

In unincorporated Cobb County, walls 30 inches and taller need a permit and a design stamped by a Georgia-registered engineer. Cities inside Cobb set their own thresholds, so the rule depends on the address.

On residential lots in unincorporated Cobb, the exposed part of a wall can't exceed six feet within five feet of the property line, and tiered walls must be at least five feet apart.

Usually the property owner or association named in the recorded maintenance agreement. Marietta's agreement, for example, requires annual inspections and lets the city do the work and bill the owner if problems aren't fixed.

Georgia requires a 25-foot undisturbed buffer along most streams and 50 feet along designated trout waters. Work inside the buffer generally needs a state variance.

Georgia's erosion and sedimentation law exempts minor work like home landscaping and repairs, and single-family construction that disturbs less than an acre. Local governments can still require their own permits, and stream buffers still apply.
